We, Cross Light Capital Sdn Bhd (Registration No. 201901034174 / 1343504-X) (“We” or “us”) are committed to protecting the privacy of our investors, in line with the Personal Data Protection Act 2010 (“Act”) in conducting our investment management business. “Personal Data” is information that identifies and relates to you or other individuals ( such as your joint account holder and/or directors if applicable). In this statement, we describe to you how we handle your Personal Data that we collect through the Investment Management Agreement (the “IMA”), and through other means (for example, from your written instructions, telephone calls, e-mails, what’s app messages and/or other communications or correspondences with us, as well as from our representatives, business partners, or other third party involved in our business dealings with you).

Obligatory to supply your Personal Data:
  • It is obligatory for you to supply your Personal Data to us to enable us to use it as described on Section 3 below. Your failure to provide your Personal Data may cause us to be unable to provide you any of the services described herein.

  • To send you important information regarding changes to our policies, other terms and conditions and other administrative information.
  • To assess your eligibility for suitable investment plans, and process your funds and other payments.
  • To prevent, detect and investigate crime, including fraud and money laundering, and analyze and manage other commercial risks.
  • To allow you to participate in contests, prize draws, promotions and entertainment, sporting activities, and to administer these activities. Some of these activities have additional terms and conditions, which could contain additional information about how we use and disclose your Personal Data, which you must read carefully.
  • To comply with internal policies and procedures such as auditing, finance and accounting, IT systems; data and website hosting; business continuity; and records, documents and print management.
  • To resolve complaints, and handle requests for data access or correction.
  • To comply with legal processes; and respond to requests from public regulatory and governmental authorities.
  • To establish and defend the legal rights privacy, safety or property of our company and/or related companies, and to pursue available remedies or limit our damages.

  • Enable the Custodian and/or designated Broker to perform the custodial functions and brokerage related services to enable attribution of your assets belonging to you.
  • Enable the Custodian and/or designated Broker to notify you promptly and make proper arrangements to safe keep your assets prior to termination of any custodial and/or designated Broker arrangements.
  • Enable the Custodian and/or designated Broker to deliver your transaction statements directly to you.
  • Enable us to perform annual evaluation of the appointed Custodian and/or designated Broker and its services to ensure that the Custodian and/or designated broker has carried out its responsibilities with due care, skill and diligence.
  • To obtain credit information which belongs to you as the account holders (individual accounts) or as the authorized signatory for the account (corporate account) for the purposes of assessing and processing your investment account.
Your right to access your Personal Data and make connection requests, raise questions and concerns:
  • You shall be given access to your Personal Data held by us and you shall be able to correct that Personal Data where the Personal Data is inaccurate, incomplete, misleading or not up to date, except where compliance with a request to such access or correction is refused under the Act.
